ORDER - Amendments to Rules for Lawyer Disciplinary Enforcement

Pursuant to Article V, § 4 of the South Carolina Constitution, Rules 17(e) and Rule 31(a) of the Rules for Lawyer Disciplinary Enforcement (RLDE) contained in Rule 413 of the South Carolina Appellate Court Rules (SCACR) are amended as indicated in the attachment to this order.

ORDER - Amendment to Rules for Judicial Disciplinary Enforcement

Pursuant to Article V, § 4 of the South Carolina Constitution, Rules 17(e) of the Rules for Judicial Disciplinary Enforcement (RJDE) contained in Rule 502 of the South Carolina Appellate Court Rules (SCACR) is amended as indicated in the attachment to this order.

6-8-2010 - Opinions

26825 - Aakjer, et al v. City of Myrtle Beach

In this declaratory judgment action, the Court held the City of Myrtle Beach Helmet Ordinance failed under implied field preemption and that certain Motorcycle Ordinances were impliedly repealed by the ordinance repealing the City's administrative hearing system.

6-14-2010 - Opinions

26826 - O'Neill v. Smith

The question certified to this Court asks whether it would violate South Carolina's public policy for a plaintiff to seek an award of punitive damages in a tort action after signing a covenant not to execute against a defendant.

26827 - Sloan v. Greenville Hospital System

We affirm a circuit court order finding the Greenville Hospital System is not a state governmental body subject to the requirements of the South Carolina Consolidated Procurement Code.

26828 - Media General v. SC Department of Revenue

The Department appeals from an order of the ALC finding it has the authority to apply the combined entity apportionment method in calculating the South Carolina taxes due from multistate corporations conducting business in South Carolina.

26829 - Chastain v. AnMed
